Official Statement Regarding Possible Reinstatement of Immigrant Family Detention

On May 11, 2023, the federal COVID-19 public health emergency order will expire, and the use of Title 42 as a mechanism to control immigration will come to an end. In anticipation of an expected increase of migrants and asylum seekers at the border, the Biden administration is reportedly exploring new policies, including a proposed new asylum rule and a potential reinstatement of family detention. 

Comprehensive immigration reform will be necessary to fully address the challenge of administering our borders. Until that can be achieved, we encourage the president to seek solutions that protect the health and welfare of the vulnerable. The negative impacts — developmental, emotional, and physical — of family detention on innocent children and their families are well supported by research. In addition, family detention is expensive and not as effective as other methods that ensure asylum seekers follow the law as they await case adjudication. We can move toward policies that honor the right to seek asylum, use resources wisely, maintain family integrity, and protect children from harm and exploitation.

A resolution to this ongoing crisis can only be accomplished by good faith collaboration and compromise between the executive and legislative branches. It cannot be accomplished by executive action alone. Congress has a responsibility to act in the best interest of the nation and in ways that honor the rule of law and our national values of compassion and decency.

Since its inception, our nation has been enriched by the economic, cultural, and social contributions of immigrants seeking liberty, opportunity, and safety. We call upon the president and Congress to work together to continue our long tradition of welcoming immigrants and asylum seekers through legal pathways. By treating these future Americans and guest workers — particularly children and families — with dignity and respect, we all benefit from their future contributions to our national growth and progress.
