Those factors include not only the actions and character of Judge Kavanaugh but also the damage that a compromised process will do to our collective faith in our institutions.     September 28, 2018 We are deeply grateful to Senator Jeff Flake (R-AZ) for his willingness to insist upon further investigation before confirming Judge Kavanaugh. We hope that such investigation will be embraced by Senate leadership in order to address the doubt Senator Flake spoke of yesterday. If Judge Kavanaugh is confirmed without that additional process, that doubt will linger over both him and the legitimacy of the Supreme Court for the duration of his tenure. In his final remarks, Senate Judiciary Committee member Senator Jeff Flake (R-AZ) said the following: “The process is imperfect, but it’s the best the Judiciary Committee can do. . . . A large part of our mission involves voter education and engagement. We believe that constituents should be informed and should work hard to understand, not just candidates and issues, but also proposed legislation.
